California’s bail system is proceeding along two tracks for now.
On one hand, around this time last year, the state passed a law to eliminate money bail. We broke down the new law in detail here, and we weighed its pros and cons here.
The law was supposed to go into effect this October, but opponents have since qualified a referendum that will ask voters to decide whether or not it does. You’ll see that on the ballot in November 2020.
In the meantime, money bail remains in place while courts continue to prepare for the new law.
And that may be the right balance to strike, anyway. To keep the one as we, or if we, implement the other.
